In the developed societies, especially in the western countries, every citizen is active and reports consciously the illegal acts. More sensible they are towards the actions of the extra communitarians, but they are never silent about the natives as well and especially towards the people in power. I want to stress here the necessity of the cooperation of the society with the law. I do not see this cooperation only in reporting the crime but above all in the creation of a favourable climate in the relations between the state and the Community. First I want to stress that it is not yet a tradition in our country that once the law is finished, its clarification and elaboration be done. The Albanian society is tolerant but we must not allow that this tolerance fall on the shoulders of the law application. The law application is connected with the emancipation of all the society. Since 1992 there is a lot of progress in the legislation field construction, but there are serious defects as well. The law is obligatory for all. The political parties, the state functionaries, politicians, etc must respect it also. They must be an example, because their indifference or neglect to the law encourages its infringement. For example, the dismissal of the general prosecution with the approval of the Parliament and a decree of the President of the Republic creates unreasonable political debates and a decision of the Constitutional Court that brought confusion about in the public opinion weakening the reliability in the institutions.
When the law is violated important is not only the punishment measure, but above all the conviction and the understanding by everyone of the concept that after the law violation the punishment is unavoidable.
Now we have the law in force. The defects in it should be repaired, but until it is reviewed, it must be applied and above all the legal way of the revision must be followed, and not the abandonment observed from the ministries to the Parliament.
Recently we see a spirit of dialogue among political forces. The opinion supports them, but we are not seeing debates for ideas and alternatives. We cannot have a constructive dialogue when they speak about the persons and political adversaries and moreover when it is done by violating the law. The political parties have burdened the administration with party and incapable elements, exactly because there is no interest to make the administration very efficient and based on the law. This would bring a contribution of the citizens to it and to the state in general.
The civil society is a healthy and a very qualified opponent in this period of transition. This factor must be known and used so as to avoid the presence of the ordinary and incapable element in this administration. The main defect in governing the country is just the appointment of the people in the administration by the parties. Unfortunately this happens in both sides of the Albanian politics. The augmentation of the trust in the administration and law state institutions is the most important step that Albanian politics must undertake placing above all the rigorous law application.
In this period it is necessary to build the institutions for the vote security. A fair, transparent system of elections controlled by the public and the law is necessary. What is needed here is a greater commitment of the citizens because the party candidates carry always the tendency to manipulate the votes.
These are some most urgent questions, which will help us fight on healthier basis also the organised crime. Together with these remain as a preoccupation the reforms in all the systems of management and organisation of the society. This needs a special and large treatment. I believe that in the future numbers there will be a debate by this magazine.
It is necessary that the opinion know more about the reforms and the legislation. A special feature with the opinions of the citizens about the law might bring valuable contributions. |
