MEMORANDUM

FOR THE TRANSFORMATION OF POLITICO-SOCIAL SITUATION, BREAKAGE OF MONOPOLY AND PRECIPITATION OF INTEGRATION PROCESSES

WHEITING THAT IN ALBANIA:

1- The democracy is fragile and the legal state does not function.

In these 14 years, the political class has not shown any ability and was not able to preserve the values of the Albanian tradition for the order in community and state formation. Albanian people, even if it is presented with dignity in front of civilized nations until the beginning of the post communist transition, today, it is valued as an unacceptable nation in the European Union.
The institutions of the Albanian state do not have authority over the people; the law and the constitution are deprecated by the maltreatment of the politics and administrators, in opposition with the society’s interests.
The political class approves laws according to the international standards; however it neither applies nor implements them in society.
The restoration of the Kanun’s tradition for putting order in community and the blood feud custom is the reaction of a society, which is unprotected and abandoned by the state.
The crime is turned into system since the creation of the pyramidal firms during 1994-1996, violation with weapons of the institutions in 1997, weapon and radioactive elements trafficking in 1998-1999 and continues nowadays with the narcotics trafficking, contraband, corruption, lack of transparency, and reduction of the informative services and legal structures under the control of the party’s leadership.
The initiators of the creation of the pyramidal firms, organizers of the terror and violence toward people and state in the tragic events of 1997 and the political backstage after these events still remain in hiding from the Albanian people.
The laws trafficking among the parliamentary groups for the misappropriation of the public and private property, creation of the monopolies in the market and the restriction of the medias’ and civil society’s liberty is an index that this political class cannot cut the connections that it has with the organized crime.
The political ruling groups have continuously violated the electoral law by attaining power on the vote. It is very difficult for every Albanian citizen to think that he/she can contribute or be part of the resolving of the problems with his/her vote or attitude.
The development of democracy, social reforms and the political life are under negative influence of a minority, which is empowered by illegal means. This ruling class has continuously generated the incitement of social conflicts, the psychology of murder, hate and the historical divisions, for holding the political monopoly.

2- The economical-social situation is getting worse.

The Albanians’ life and economy is in the level of the poorest countries of the world and is mainly hold by the efforts of hundred thousands emigrants, that in these 14 years have worked with the hope that they will come back soon for investment in their country.
The reforms, economy, production of the country and tourism have been obstructed by the political usurping clans and the war without principles between them. The property law continues to cause bloodshed. The country is abandoned and destroyed; there is lack of electricity, water and communication. The violence and murders have gained ground even within the family.
During these years, approximately 8 billion dollars, collected from Albanian taxpayers and 1.5 billion dollars given by the international donors, have served more to the corruption and organized crime than the development of the country.
The population suffers under the stress of extreme poverty, lack of most elementary services and life security. The majority of the citizens has lost the hopes for the futures and is living in a slothful, sluggish and apathetic way. The unemployment has reached the highest rates in the East countries. Many young people have chosen the way of crime; thousand girls are obligated to work on the streets of Europe as prostitutes, because they cannot find any way out.
The governments, in stead of encouraging, have obstructed the development of the market and productive activities of the country. The forests, productive lands and the agricultural infrastructure have been destroyed. The market politics favor the import merchandises which guarantee neither the quality nor the security of citizens’ health and life.

3- The politics obstructs and aims to have control over the civil society

For over a year by now, the Albanian civil society is trying to raise the public awareness and culture about protesting, as a very important factor to democracy. The public opinion is now supporting new forms of protests led by the civil society. However, these peaceful and civil protests, the civil society and the media that have supported them, are facing a strong political pressure, with accuses, threats and pressure in media and denigration of protagonists.
We consider the pressure, provocations and threatening towards the civil society, for giving up the protest against the decisions of the government and acts of the political class, as a flagrant violation of universal human rights, the constitution and laws in force, and segregation against democracy.
This pressure is the continuity of the strategy of the political clans, implicated with the crime in these 14 years that aim to hold the monopoly and obstruct every current that might bring the development of the reforming processes and any new politico-social movement. The war for maintaining the monopoly has continuously brought the manipulation of the polls and deprecation of the electoral process.
The country, during these 14 years, is lead by two parties, which although at the beginning were supported by the majority of the electorate, currently, together with all the other parties falling within the same political spectrum, are not supported by more than 35% of the voters. After 14 years of transition, 65% of the population does not participate in the voting process. The population is not represented by 70% of parliamentary members – this percentage of the Albania population is represented neither in the decision-making process nor in its governing.
The positive values found amongst some individuals within the current politician class are not negated, however the political class as a whole has entered an abyss that is bringing to this country continuous crises, corruption, organized crime, regress and tragedy. The majority of militants that are employed in the administration consider the office as a profitable mean. For this reason 25,000 girls and boys, graduated with very high results from university, are waiting to emigrate abroad, because they are offered neither political auditoriums nor positions within the state administration.
The media although having marked some progress in variety and professionalism, are under the control of politics - as a result they have failed to move the society forward. The Albanian intelligence, affirmed for its high level in the world, continues to emigrate unappreciated, deluded and without any way out.
Existing political parties are showing an interest in compromising trade union movements and civil society initiatives, by polarizing, eclipsing, dividing and making their activity inefficient. In a demagogic way the actual political leadership has uses the women and youth forums as “décor” in these parties, in order to justify their presence in politics and decision making processes, and for the ruling of the actual leadership.
Unfortunately, the international community has not analyzed with objectivity the Albanian political parties, which do not have a mission, are not led by democratic principles or reform themselves. The democracy and reforms required by the international community are caught on a crossroad.
Albanians have received the message that only after year 2025 they can join the European Union. This message makes it clear that accelerating our movement towards Europe means accelerating the reformation process – and, on the first place, this requires the reformation of the political class with new people, new visions and a true political mission.

TAKING IN CONSIDERATIONS THE FOREGOING ISSUES:

The Network for Democracy and State of Rules of Law is addressing to: President of the Republic, Chairman of the Albanian Parliament, Prime Minister of Republic of Albania, chairpersons of the religious beliefs, OSCE, European public opinion, governments of European Union member countries, USA State Department and the nationwide public opinion to contribute and exercise the necessary authority with the view to bring to an end the current situation. After the civil unrest of 1997, the Albanian population continues to be traumatized and has no faith in politics. Without the help of these interior and exterior positive factors, the situation can not be transformed.
The foundation of a social wide movement for a new Albanian political class, which is not implicated with the crime and manners of the actual contingent; and with a clear program about the reforms and integration, by individuals or groups of citizens, especially young people and intellectuals, is necessary and precious for the country.
The Network for Democracy and State of Rules of Law invites intellectuals and young people of civil society, private and state institutions, medias and businesses staffs, auditors of the political parties and governing departments to take with courage the initiative for the foundation of this factor, by taking political responsibility for the country.

The Network for Democracy and State of Rules of Law claims to the Albanian Parliament and President of Republic of Albania:

1- The reformulation of the Electoral Code for the security of democracy, guaranteeing the inviolability of the vote, participation of all citizens in the polls, not based on the agreements of the two big parties, but on the qualified thoughts of the specialists and civil society.
2- The revision of the law about the political parties for not permitting the phenomenon Party-State appear and for establishing democratic relationships between the parties and civil society, which is in interest of the broadening of consolidation of democracy
3- The revision of law about the chastity of the personality of the politician and declaration of wealth so that, apart the special commission, this activity is object of the State Informative Service.
4- State Informative Service should be under the subordination of President of Republic of Albania.
5- The establishment of a National Commission for the investigations of the connections of crime with politics, for tracking the organizers of the violation of the state institution, murders and terror on the population, during the events of 1997, and the implication of the political class with all this.
